What Are the Global Rules for Marijuana Edible Packaging?

United States: Federal Child-Resistant Standards (CPSC 16 CFR §1700.20)

All marijuana edible packaging entering the United States must comply with federal child-resistance regulations under CPSC 16 CFR 1700.20,as enforced regulated by the Consumer Product Safety Commission (CPSC). This rule applies in addition to all state regulations.

Key requirements:

Each package design must demonstrate that 80% of children under 52 months of age cannot open it without adult assistance,and that 90% of adults are able to open the package without adult assistance.

Testing is conducted on adults and children in a controlled environment.

Child resistant reclosable containers must remain child resistant over 100 open-close cycles. CPSC 16 CFR 1700.20 rules for 2026 indicate that this can be achieved through 300 open-close cycles.

ASTM D3475: The Technical Standard for Child-Resistant Package Design

Key requirements under the Cannabis Regulations (SOR/2018-144):

Plain Packaging:The packaging cannot feature colored materials,metallic finishes,or special effects. Only the brand name and product type printed in a standard typeface on a single neutral colored background.

Child-resistance:It is required on all edibles and tested with CPSC 16 CFR 1700.20.

Health Warning:All packaging must contain Health Canada's warning that states at least 50% of the display panel must be dedicated to the warning.

No glossy or metallic effects:Finishes that gives the impression of being premium or luxurious are prohibited.

European Union: Focus on Food Contact and Novel Foods

While cannabis legalization varies widely across the EU,there is a commonality to the regulations around the sale of CBD edibles derived from industrial hemp (THC <0.2%) that may appear in a state regulated market.

Novel Food authorization:CBD edibles require novel food authorization and must indicate they are a novel food.
